1. AGREEMENT TO TERMS
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you", "User", "Customer") and The Other Way, which is a registered trade name operated by Schmetterlink LLC (collectively referred to as the "Company", "we," "us" or "our"), concerning your access to and use of our website, as well as the purchase of any digital products, courses, templates, or services (collectively, the "Products") offered by us.
By purchasing a Product, you agree that you have read, understood, and agree to be bound by all of these Terms of Service.
2. INTELLECTUAL PROPERTY & LICENSE TO USE
All Products sold are the exclusive intellectual property of the Company. When you purchase a digital product, you are purchasing a revocable, non-exclusive, non-transferable license for personal, non-commercial use.
You agree that you shall NOT:
- Copy, reproduce, modify, or create derivative works from the Product.
- Sell, rent, lease, sub-license, distribute, or otherwise transfer the Product to any third party.
- Share your login credentials or access links with anyone else.
- Use the Product for any commercial purpose without explicit written consent from us.
Any unauthorized use of our intellectual property will result in immediate termination of your access without a refund and may lead to legal action.
3. PAYMENTS, PRICING, & THIRD-PARTY PROCESSING
All payments are processed securely through our third-party payment processor, Stripe. We do not store or have direct access to your full credit card information.
- By providing a payment method, you expressly authorize us (via Stripe) to charge the applicable fees to said payment method, as well as taxes and other charges incurred thereto at regular intervals, all of which depend on your particular purchase.
- All prices are shown in USD and you are responsible for any currency conversion fees charged by your bank.
- In the event of a failed payment, your access to the Product will be immediately revoked until payment is successfully processed.
4. REFUND & CHARGEBACK POLICY
Due to the digital, non-returnable nature of this Product, all sales are final, except as set out in our Refund Policy. By completing your purchase, you acknowledge and agree that you waive your right to a refund, except as set out in our Refund Policy.
Chargeback Clause: You agree to contact us at hello@wearetheotherway.com to attempt to resolve any billing disputes before contacting your bank or credit card company to request a chargeback. In the event of an unjustified chargeback, we reserve the right to dispute the claim with Stripe, terminate your access to the Product permanently, and ban you from future purchases. Fraudulent chargebacks will be reported to the appropriate authorities.
5. DISCLAIMER OF WARRANTIES & GUARANTEES
The Products are provided on an "as-is" and "as-available" basis. Schmetterlink LLC (d/b/a The Other Way) makes no guarantees regarding specific results, financial earnings, business growth, or performance from using our Products.

In no event shall our total liability to you exceed the total purchase price of the Product you purchased.
7. GOVERNING LAW & DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of Wyoming, USA, without regard to its conflict of law principles. Any legal action or proceeding arising out of your purchase or use of the Product shall be brought exclusively in the courts located in Wyoming, USA, and the parties consent to the jurisdiction of such courts.
